TERMS OF SERVICE

INCLUDING SHIPPING SERVICES TERMS

OVERVIEW

This website and the services offered through it are operated by Kübox LLC, a Texas limited liability company, doing business as Trunkmoves (“Kübox,” “Trunkmoves,” “we,” “us,” or “our”).

For clarity, all services, charges, and billing are provided by Kübox LLC, which operates the Trunkmoves® platform. Brand names such as Trunkmoves®, Kübox®, KuboxShips®, Border-Box®, MiniKub®, MicroShip® and related marks are trade names only and do not create separate contracting parties.

Trunkmoves provides a self-service shipping platform that enables customers to arrange shipments using independent third-party carriers. By accessing the website, creating an account, or purchasing services, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Services.


ORDER OF PRECEDENCE

If there is any conflict between documents:

  1. Carrier tariffs, waybills, air waybills, or bills of lading govern all matters relating to transportation, handling, loss, damage, delay, and delivery.
  2. These Shipping Services Terms govern Kübox platform services, pricing structure, customer obligations, fees, and limitations of Kübox liability.
  3. General website use provisions govern non-shipping matters.

SECTION 1 – ELIGIBILITY & ACCOUNT RESPONSIBILITY

You represent that you are at least the age of majority in your jurisdiction and have authority to enter into these Terms on behalf of yourself or the entity you represent.

You agree to provide accurate, complete, and current account information and to update it as necessary.


SECTION 2 – PLATFORM ROLE (NON-CARRIER)

Kübox is not a carrier, freight forwarder, or transportation provider. Kübox does not transport goods and does not control carrier operations.

Kübox provides technology, booking coordination, billing, documentation assistance, and customer support only. All physical transportation is performed exclusively by independent third-party carriers.


SECTION 3 – DEFINITIONS

  • Carrier: An independent transportation company that physically moves shipments.
  • Shipment: One or more packages tendered to a Carrier under a single tracking number or waybill.
  • Platform Services: Kubox’s technology, booking, labeling, documentation, billing, and support services.
  • Customer / You: The individual or legal entity purchasing services.

SECTION 4 – CUSTOMER OBLIGATIONS

You are solely responsible for:

  • Proper packing in accordance with carrier requirements and industry standards
  • Accurate descriptions, dimensions, weights, and contents
  • Excluding prohibited, restricted, or dangerous items
  • Providing accurate pickup and delivery information
  • Reviewing labels, schedules, and documentation before tender

You represent that you have lawful authority to ship all contents.


SECTION 5 – PRICING, BILLING & PAYMENT

(Flat-Price Bundled Services)

Kübox offers flat, all-in pricing for shipments purchased through the Platform. This pricing includes third-party carrier transportation bundled together with Kübox Platform Services, including label creation, documentation processing, booking coordination, and administrative support.

Kübox Platform Services are performed immediately upon booking, and the flat price represents a single, integrated service offering. As a result, the flat price cannot be separated, itemized, prorated, or partially refunded, regardless of carrier performance, delivery outcome, or claim resolution.

Shipping purchases are non-refundable once labels or documentation are generated, except where required by applicable law.


SECTION 6 – FEES FOR CHANGES & EXCEPTIONS

The following fees apply only when customer-requested changes, corrections, or exceptions require additional manual processing by Trunkmoves after booking. These fees are not penalties and do not apply to shipments processed as booked.

  • Pickup Change: $75
  • Missed Pickup: $135
  • Label Change (customer error): $75
  • Same-Day Label Creation: $75
  • Delivery Hold or Address Change: $135
  • Split Delivery (Domestic Only): $50
  • International Document Revisions: $75 per occurrence

Carrier-imposed fees remain the Customer’s responsibility.


SECTION 7 – LOSS, DAMAGE & DELIVERY ISSUES

If a shipment is delayed, lost, or damaged, claims are governed by the carrier’s terms and must be reviewed and resolved by the carrier.

To assist customers, Trunkmoves provides an online claim information form that collects shipment details, descriptions, photographs, and other information commonly required by carriers. Information submitted through this form is transmitted as entered to the carrier for claim review.

Trunkmoves’ involvement is administrative only. Trunkmoves does not evaluate, decide, approve, deny, or pay claims, and does not assume responsibility for carrier claim outcomes. Final determination and resolution rest solely with the carrier.


SECTION 8 – DISCLAIMER OF WARRANTIES

Kübox does not guarantee that the Services will be uninterrupted, timely, secure, or error-free, or that carrier performance will meet any particular expectation.

The Services and Platform Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied.


SECTION 9 – LIMITATION OF LIABILITY

Kübox is not liable for losses caused by carrier handling, delays, damage, misdelivery, or delivery outcomes, all of which are governed by the carrier’s shipping documents.

To the maximum extent permitted by law, Kübox’s total aggregate liability, if any, arising from Platform Services or bundled flat-price shipping shall not exceed the lesser of USD $150 or the portion of the flat price reasonably attributable to Kübox Platform Services, as determined by Kübox in good faith.

Kübox is not liable for indirect, incidental, consequential, or economic losses, including loss of use, loss of value, lost profits, or business interruption.

Nothing in these Terms limits liability that cannot be limited under applicable law.


SECTION 10 – PROHIBITED & RESTRICTED ITEMS

You may not ship prohibited, restricted, or dangerous goods. You agree to indemnify and hold harmless Kübox from any loss, penalty, or expense arising from undeclared or prohibited contents.


SECTION 11 – TERMINATION

Kübox may suspend or terminate Services at any time for non-payment, misuse, inaccurate information, or violation of these Terms. All accrued obligations survive termination.


SECTION 12 – GOVERNING LAW & VENUE

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Exclusive venue lies in state or federal courts located in Texas.


SECTION 13 – SEVERABILITY

If any provision is held unenforceable, the remaining provisions remain in full force and effect.


SECTION 14 – ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and Kübox regarding the Services and supersede all prior agreements or understandings.


SECTION 15 – CHANGES TO TERMS

Kübox may update these Terms at any time by posting revisions. Continued use constitutes acceptance.
